Criminal and civil law obligations to minimise risk of psychiatric injury – Katherine Morris

Katherine Morris, Partner, Norton Rose Fulbright

Are you up-to-date on your legal obligations to prevent psychiatric injury in the workplace? Katherine examined the recent High Court case of Kozarov v State of Victoria [2022] HCA 12 and the new obligations under the WHS regulations to identify and mitigate work-related psychosocial hazards. We learned how Courts assess whether an employee’s risk of psychiatric injury is foreseeable and whether an employer has a relevant duty of care to proactively reduce the risk of injury.
